Maddesi uyar\u0131nca, yabanc\u0131 uyruklu ger\u00e7ek ki\u015filerin \u00fclkemizde ta\u015f\u0131nmaz edinmesinde kar\u015f\u0131l\u0131kl\u0131l\u0131k \u015fart\u0131 aranmas\u0131 uygulamas\u0131 terk edilmi\u015ftir. \u00dclkemizde ta\u015f\u0131nmaz ve s\u0131n\u0131rl\u0131 ayni hak ediminizin m\u00fcmk\u00fcn olup olmad\u0131\u011f\u0131 konusunda \u00fclkenizdeki T\u00fcrkiye B\u00fcy\u00fckel\u00e7ili\u011fi veya Ba\u015fkonsolosluklar\u0131ndan veya \u00fclkenizin T\u00fcrkiye\u2019deki temsilciliklerinden bilgi alman\u0131z m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>Yabanc\u0131 uyruklu ger\u00e7ek ki\u015filer, kanuni s\u0131n\u0131rlamalara uyulmak kayd\u0131yla, \u00fclkemizde nitelik bak\u0131m\u0131ndan her t\u00fcrl\u00fc ta\u015f\u0131nmaz (Konut, \u0130\u015fyeri, Arsa, Tarla) edinebilmektedir.<\/p>\n<p>Yabanc\u0131 uyruklu ger\u00e7ek ki\u015filer, sat\u0131n ald\u0131klar\u0131 yap\u0131s\u0131z ta\u015f\u0131nmazda (Arsa, Tarla) geli\u015ftirece\u011fi projeyi iki y\u0131l i\u00e7inde ilgili Bakanl\u0131\u011f\u0131n onay\u0131na sunmak zorundad\u0131r.<\/p>\n<p>S\u00f6zle\u015fmelerin resmi bir \u015fekilde T\u00fcrkiye\u2019de y\u00fcr\u00fcrl\u00fckteki mevzuata g\u00f6re, ta\u015f\u0131nmaz m\u00fclkiyetinin devri Tapu M\u00fcd\u00fcrl\u00fcklerinde imzalanacak resmi senet ve tescil ile m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>Noter huzurunda \u201csat\u0131\u015f vaadi s\u00f6zle\u015fmesi\u201d imzalanmas\u0131 gerekmektedir. Ancak noter huzurunda imzalanan \u201csat\u0131\u015f vaadi s\u00f6zle\u015fmesi\u201d veya harici sat\u0131\u015f s\u00f6zle\u015fmesi ile ta\u015f\u0131nmaz m\u00fclkiyetinin kazan\u0131lmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Yabanc\u0131lar\u0131n ta\u015f\u0131nmaz ediniminde kanuni s\u0131n\u0131rlamalar ve \u00f6nemli hususlar a\u015fa\u011f\u0131da belirtilmi\u015ftir. Bunlar;<\/p>\n<p>Yabanc\u0131lar\u0131n ta\u015f\u0131nmaz ediniminde kanuni s\u0131n\u0131rlamalar\u0131n en \u00f6nemli hususlar\u0131ndan biri sat\u0131lacak gayrimenkul\u00fcn askeri ve \u00f6zel g\u00fcvenlik b\u00f6lgelerinde kal\u0131p kalmad\u0131\u011f\u0131n\u0131n Tapu M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan yetkili komutanl\u0131\u011fa sorulmas\u0131 ve olumlu cevap al\u0131nmas\u0131d\u0131r. Yakla\u015f\u0131k 1 ve 1,5 ay s\u00fcre i\u00e7erisinde ger\u00e7ekle\u015fmektedir.<\/p>\n<p>\u00dclke genelinde, yabanc\u0131 uyruklu bir ger\u00e7ek ki\u015fi, en fazla 30 hektar (300.000 m2 ) ta\u015f\u0131nmaz sat\u0131n alabilir ve s\u0131n\u0131rl\u0131 ayni hak edinebilir.<\/p>\n<p>Yabanc\u0131lar\u0131n askeri yasak b\u00f6lgeler ve g\u00fcvenlik b\u00f6lgelerinde ta\u015f\u0131nmaz edinimi ve kiralamas\u0131 m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>Yabanc\u0131 uyruklu ger\u00e7ek ki\u015filer, \u00f6zel m\u00fclkiyete konu il\u00e7e y\u00fcz \u00f6l\u00e7\u00fcm\u00fcn\u00fcn %10\u2019una kadar ta\u015f\u0131nmaz ve s\u0131n\u0131rl\u0131 ayni hak edinebilir.<\/p>\n<p>Ger\u00e7ek ki\u015filerle yabanc\u0131 \u00fclkelerde kendi mevzuatlar\u0131na g\u00f6re kurulan t\u00fczel ki\u015fili\u011fe sahip ticaret \u015firketleri lehine ta\u015f\u0131nmaz rehni tesisinde kanuni s\u0131n\u0131rlamalar uygulanmaz.<\/p>\n<p>Kanun h\u00fck\u00fcmlerine ayk\u0131r\u0131 olarak edinilen; edinim amac\u0131na ayk\u0131r\u0131 kullan\u0131ld\u0131\u011f\u0131 ilgili Bakanl\u0131k ve idarelerce tespit edilen; proje \u015fart\u0131yla sat\u0131n almalarda s\u00fcresi i\u00e7inde ilgili Bakanl\u0131\u011fa ba\u015fvurulmayan veya s\u00fcresi i\u00e7inde projeleri ger\u00e7ekle\u015ftirilmeyen; ta\u015f\u0131nmazlar tasfiye h\u00fck\u00fcmlerine tabidir.<\/p>\n<p>\u0130lgili Belediyeden al\u0131nan &#8221;Emlak Beyan De\u011feri&#8217;nden az olmamak \u00fczere sat\u0131\u015f bedeli \u00fczerinden, hem al\u0131c\u0131 hem sat\u0131c\u0131 taraf\u0131ndan tapu harc\u0131 \u00f6denir. (492 say\u0131l\u0131 Har\u00e7lar Kanununa g\u00f6re 2013 y\u0131l\u0131 i\u00e7in belirlenen tapu harc\u0131 oran\u0131 %2\u2019dir)<\/p>\n<p>Y\u00f6resel olarak belirlenen d\u00f6ner sermaye \u00fccreti \u00f6denir. (2013 y\u0131l\u0131 i\u00e7in en fazla 70&#215;2.5 TL)<\/p>\n<p>Ta\u015f\u0131nmaz\u0131n askeri ve \u00f6zel g\u00fcvenlik b\u00f6lgeleri d\u0131\u015f\u0131nda kal\u0131p kalmad\u0131\u011f\u0131n\u0131n Tapu M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan yetkili komutanl\u0131\u011fa sorulmas\u0131 a\u015famas\u0131nda gerekirse Kadastro M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce haz\u0131rlanan harita i\u00e7in d\u00f6ner sermaye \u00fccreti \u00f6denir. (2013 y\u0131l\u0131 i\u00e7in: 323 TL\u2019dir. 2014 y\u0131l\u0131 i\u00e7in de\u011fi\u015fiklik olmam\u0131\u015ft\u0131r)<\/p>\n<p>Ta\u015f\u0131nmaz maliki veya yetkili temsilcisinin, Tapu M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019ne \u00f6n ba\u015fvuru yapmas\u0131 gerekir. Bu ba\u015fvurular\u0131 ta\u015f\u0131nmaz\u0131n ba\u011fl\u0131 bulundu\u011fu Tapu M\u00fcd\u00fcrl\u00fcklerine s\u0131ra al\u0131narak, yabanc\u0131 uyruklu ger\u00e7ek ki\u015filerin ta\u015f\u0131nmaz edinimleri i\u00e7in ilgili tapu sicil m\u00fcd\u00fcrl\u00fcklerine ba\u015fvurular\u0131nda yan\u0131nda bulundurmas\u0131 gereken evraklar:<\/p>\n<p>Ta\u015f\u0131nmaz\u0131n Tapu Senedi Belgesi veya k\u00f6y\/mahalle, ada, parsel, bina, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm bilgisi,<\/p>\n<p>Kimlik belgesi veya pasaport ( Pasaportun terc\u00fcmesinin yeminli terc\u00fcman onayl\u0131 sureti)<\/p>\n<p>Ta\u015f\u0131nmaz edinimleri ikamet iznine tabi yabanc\u0131lar\u0131n ilgili emniyet m\u00fcd\u00fcrl\u00fcklerinden verilen ikamet tezkerelerini<\/p>\n<p>\u0130lgili Belediyeden, ta\u015f\u0131nmaz\u0131n &#8221;Emlak Beyan De\u011feri Belgesi&#8221;nin al\u0131nmas\u0131,<\/p>\n<p>Binalar i\u00e7in (konut, i\u015fyeri\u2026 vb.) zorunlu deprem sigortas\u0131 poli\u00e7esi,<\/p>\n<p>Sat\u0131c\u0131n\u0131n 1 adet, al\u0131c\u0131n\u0131n 2 adet foto\u011fraf\u0131 (son 6 ay i\u00e7inde, 6&#215;4 ebad\u0131nda)<\/p>\n<p>T\u00fcrk\u00e7e bilmeyen taraf varsa yeminli terc\u00fcman ile iki tan\u0131k,<\/p>\n<p>Yurt d\u0131\u015f\u0131nda d\u00fczenlenen vek\u00e2letname ile i\u015flem yap\u0131lmas\u0131 halinde, terc\u00fcmesiyle beraber vek\u00e2letnamenin asl\u0131 veya onayl\u0131 \u00f6rne\u011fi<\/p>\n<p>Yurt d\u0131\u015f\u0131nda d\u00fczenlenen vek\u00e2letnamelerin \u00f6zellikleri:<\/p>\n<p>T\u00fcrkiye Cumhuriyeti B\u00fcy\u00fckel\u00e7ili\u011fi veya Konsoloslu\u011funca d\u00fczenlenen vek\u00e2letnameler:<\/p>\n<p>Yabanc\u0131 \u00fclke noterlerince d\u00fczenlenen vek\u00e2letnameler, 5 Ekim 1961 tarihli Lahey S\u00f6zle\u015fmesine g\u00f6re tasdik edilip, tasdik \u015ferhinin \u00fclke lisan\u0131 yan\u0131nda Frans\u0131zca \u201cApostille (Convention de La Haye du Octobre 1961)\u201d ibaresini de ta\u015f\u0131mas\u0131 halinde bu t\u00fcr belgeler ve vek\u00e2letnameler ile T\u00fcrk\u00e7e terc\u00fcmelerinde ayr\u0131ca o yerdeki T\u00fcrk Konsoloslu\u011funun tasdiki aranmaz.<\/p>\n<p>Ayr\u0131ca 5 Ekim 1961 tarihli Lahey s\u00f6zle\u015fmesine taraf olmayan yabanc\u0131 \u00fclkelerin noterlerinin d\u00fczenledi\u011fi vek\u00e2letnamelerde ki noterin imzas\u0131n\u0131n ba\u011fl\u0131 bulundu\u011fu makam taraf\u0131ndan, bu makam\u0131n imza ve m\u00fchr\u00fc o yerdeki T\u00fcrk Konsoloslu\u011funca onaylan\u0131r.<\/p>\n<p>\u00dclkemizde ta\u015f\u0131nmaz edinmek isteyen yabanc\u0131lar\u0131n dikkat edece\u011fi di\u011fer hususlar:<\/p>\n<p>Ta\u015f\u0131nmaz \u00fczerinde, ipotek, haciz vb. bir k\u0131s\u0131tlama bulunup bulunmad\u0131\u011f\u0131 veya ta\u015f\u0131nmaz\u0131n sat\u0131\u015f\u0131na engel herhangi bir durumun bulunup bulunmad\u0131\u011f\u0131 gibi hususlar ilgili Tapu M\u00fcd\u00fcrl\u00fc\u011f\u00fcnden kontrol edilmelidir.<\/p>\n<p>Ta\u015f\u0131nmaz edinme ba\u015fvurusunun reddi halinde, i\u015flem yap\u0131lan Tapu M\u00fcd\u00fcrl\u00fc\u011f\u00fc&#8217;n\u00fcn ba\u011fl\u0131 oldu\u011fu B\u00f6lge M\u00fcd\u00fcrl\u00fc\u011f\u00fc&#8217;ne itiraz ba\u015fvurusu yap\u0131labilir.<\/p>\n<p>Uzman ve g\u00fcvenilir oldu\u011fu bilinmeyen ki\u015fi veya firmalar ile \u00e7al\u0131\u015f\u0131lmamas\u0131 \u00f6nerilir.<\/p>\n<p>Yabanc\u0131n\u0131n T\u00fcrkiye&#8217;de ta\u015f\u0131nmaz edinebilmesi i\u00e7in ikamet izni alm\u0131\u015f olmas\u0131 \u015fart\u0131 aranmamaktad\u0131r.<\/p>\n<p>Ta\u015f\u0131nmaz edinimine ili\u015fkin taraflar aras\u0131nda herhangi bir uyu\u015fmazl\u0131k \u00e7\u0131kmas\u0131 halinde, durum adli makamlara intikal ettirilerek T\u00fcrkiye Cumhuriyeti mahkemelerinde dava a\u00e7\u0131lmas\u0131 gerekmektedir.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div>","protected":false},"excerpt":{"rendered":"<p>The rule is amended to emphasize that just as the court should construe and administer these rules to secure the just, speedy, and inexpensive determination of every&#8230; <\/p>","protected":false},"author":1,"featured_media":9003,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":[],"categories":[31,32],"tags":[8,15],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v15.9.2 -
